Subject: RE: Does Ryan White apply to COVID

Mr. Schimmel,

Thank you for contacting the Centers for Disease Control and Prevention (CDC) concerning Part G of the Ryan White HIV/AIDS Treatment Extension Act of 2009. The purpose of Part G is to facilitate informing emergency response employees (EREs) that they may have been exposed to potentially life-threatening infectious diseases, so they can make better-informed decisions about subsequent measures such as diagnosis and, if necessary, prophylaxis or treatment.

The National Institute for Occupational Safety and Health (NIOSH) is part of the CDC and was delegated the authority to implement Section 2695 of Part G. In 2011, NIOSH published the Federal Register notice Implementation of Section 2695 (42 U.S.C. 300ff–131) of Public Law 111– 87: Infectious Diseases and Circumstances Relevant to Notification Requirements (https://www.cdc.gov/niosh/topics/ryanwhite/pdfs/FRN11-2-2011GPO.pdf<https://eur01.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.cdc.gov%2Fniosh%2Ftopics%2Fryanwhite%2Fpdfs%2FFRN11-2-2011GPO.pdf&data=02%7C01%7C%7Ce0dc1bc5d6ba4e7d4eb908d7d9c6cc4b%7C84df9e7fe9f640afb435aaaaaaaaaaaa%7C1%7C0%7C637217320158493297&sdata=UF7AgvfC4qHF1F8f%2Fp43wHDTqug41STncnWauODKmdE%3D&reserved=0>). This notice included:

  * A list of potentially life-threatening infectious diseases to which EREs may be exposed,
  * The guidelines describing the circumstances in which EREs may be exposed to such diseases, and
  * The guidelines describing the manner in which medical facilities should make determinations for purposes of section 2695B(d) [42 U.S.C. 300ff–133(d)].

Today, NIOSH updated the list of potentially life-threatening infectious diseases to which EREs may be exposed to include the addition of COVID-19, the disease caused by the virus SARS-CoV-2, and the definition of “emergency response employee.” The list and accompanying guidelines, originally published in a 2011 Federal Register notice, have been republished with these updates (https://www.cdc.gov/niosh/docs/2020-119/default.html<https://eur01.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.cdc.gov%2Fniosh%2Fdocs%2F2020-119%2Fdefault.html&data=02%7C01%7C%7Ce0dc1bc5d6ba4e7d4eb908d7d9c6cc4b%7C84df9e7fe9f640afb435aaaaaaaaaaaa%7C1%7C0%7C637217320158503285&sdata=4ltedp8Yj%2F%2FeZGCUjk2Gzuwex6rzoQHil3n55ZI9gEA%3D&reserved=0>).

Please let us know if you have questions on Section 2695 of Part G as described above. Questions on other sections of Part G should be directed to the Department of Health and Human Services (HHS). You can contact HHS Headquarters by calling the HHS call center at 1-800-696-6775.

We hope this information helps provide a safe and healthy workplace.

Thank you,

Chad Dowell
